This Privacy Policy explains how CAMOJOJO INC. ("we"), acting as the data controller, collects and processes your personal information when you use our CalmGuard services through the internet and mobile applications, including www.camomark.com (collectively, the "CalmGuard Services"). This Privacy Policy also applies to data collected during the operation and use of any CalmGuard product ("Product") connected to the CalmGuard Services, as well as any other CalmGuard Services we may offer.

We may update this Privacy Policy from time to time. For non-material changes (e.g., wording optimizations, example updates), we will notify you through the website or in-app notifications, and such changes will take effect upon publication. For material changes involving data processing purposes, data types, data sharing scope, etc., we will notify you via your registered email address or through prominent in-app notices, and where necessary, require you to provide renewed explicit consent (e.g., via pop-up or click-to-confirm). Without your explicit consent, we will not materially reduce the level of protection for your personal data. Please review this policy periodically to stay informed of the latest version. If you do not agree with the revised policy, you must terminate your account within this 30-day period. Continued use after this period will constitute your acceptance of the changes. We will specifically mention this 30-day period and its implications in the notification.

1. Information We Collect

By using this application, you agree that we collect the following information:

• Account Information: When you create or log in to an account through the application, we collect your username and email address to manage your account.
• Subscription Information: If you subscribe to paid services, we collect relevant billing and order information.
• Device and Usage Information: After logging in, we may collect device information used to access the application, including device identifiers, IP addresses, device types, operating systems, and usage data (e.g., timestamps and feature usage).
• Camera Data: When you add a camera through the application, video, images, audio, and sensor data captured by the device may be uploaded to our servers or cloud storage for functions such as AI recognition.
• Location Information (if applicable): For services that require positioning (e.g., device tracking), we may collect coarse or precise location data, such as country, region, coordinates, time zone, and language settings. You acknowledge that security cameras are typically deployed in private locations, and geographic location data associated with your device and captured content is considered sensitive information.
• Application Usage Information: Including in-app unique identifiers (e.g., Instance ID), installed application data, SDK version, update settings, app configuration (region, language, time zone, font), app foreground/background activity status, and status records (e.g., installation, updates, deletion).
• Network and Connection Data: Including information generated when connecting to 4G/5G networks and related geolocation data.
• Communication and Support: When you contact us for support or inquiries, we collect your email address, phone number, and the content of your communications.

Important Notice: The login page does not read any personal or device data. All data access occurs after login. Third-party SDKs do not collect personal or sensitive user data, and any processed data is securely encrypted and stored in our database.

2. Non-Personal Information

We may collect and use aggregated or de-identified data in accordance with applicable law, which cannot identify any individual. This may include:

• Statistical data related to service usage (e.g., anonymized device metrics, session activity, screen time).
• Network performance metrics (e.g., request duration, error rates).
• Crash reports and system logs generated by application errors.

This information helps us improve the quality and performance of our services.

3. How We Use Your Information

We use the collected information for the following purposes:

• Service Provision and Enhancement: Operating, maintaining, and improving the application and services, including device configuration and media transfer.
• AI Recognition: Based on locally-deployed artificial intelligence recognition technology (hereinafter "AI Recognition Feature"), analyzing images captured by the camera device paired with this App to identify the biological species and specific breed in the images, and returning the recognition results to you.
• Customer Support: Responding to your inquiries, providing technical assistance, and resolving service issues.
• Account Management: Managing your account, processing subscriptions, and sending service-related notifications.
• Security and Anti-Fraud: Detecting, investigating, and preventing fraud or abuse.
• Legal Compliance: Complying with applicable laws and regulations.
• Marketing and Notifications: With your consent, we may send disclosures, messages, notifications, and other communications (including direct marketing text messages) to your designated mobile phone and email account. You may opt out of marketing communications at any time.

4. Data Sharing and Disclosure

We do not sell or rent your personal data. We only share data in the following circumstances:

• Service Providers: We may share necessary data with third-party providers (e.g., cloud storage, payment processors) under strict contractual obligations, limiting their use to supporting our services.
• Legal Obligations: We may disclose your data to comply with applicable laws, government requests, court orders, or matters involving public interest or law enforcement.
• Rights Protection: We may disclose data when necessary to enforce our Terms of Service, protect our lawful rights, prevent fraud, or ensure user and public safety.
• Business Transfers: In the event of a merger, acquisition, restructuring, or asset sale, your information may be transferred. We will notify you of any such changes via email, the application, or other appropriate means. You have the right to refuse the transfer by deleting your account before the transfer. Unless you actively delete your account, your data will be subject to the receiving party's privacy policy after the transfer. If you continue to use our services after receiving notice, it shall be deemed that you consent to the transfer; however, you may exercise the aforementioned deletion right at any time.

5. Data Storage and Security

We are committed to protecting your data:

• All collected data is securely stored on protected servers.
• We employ encryption and technical safeguards to prevent unauthorized access, disclosure, alteration, or destruction.
• Data access is restricted to authorized employees and partners, who are bound by strict confidentiality agreements.
• We regularly review and update our data protection practices.
• In the event of a data breach, we will notify relevant regulatory authorities and affected users as required by law.

6. Data Retention

We retain personal data only for as long as necessary to fulfill the purposes for which it was collected, or as required by applicable law. Once the purpose is achieved, or upon user request/account deletion, we will delete or anonymize the data, unless phased clearing is required by backup systems.

7. Privacy Controls

You can manage your privacy settings in the following ways:

• Log Out: Logging out will stop all data access by the application.
• Add/Remove Cameras: Add or remove cameras in the "My Devices" section; upon removal, we will stop collecting camera data.
• Edit User Information: Update or correct your information in the application settings.
• Account Deletion: Delete your account within the application to remove associated personal data.

8. Your Rights

Depending on your location, you may have the right to:

• Request access to, correction of, or deletion of your personal data.
• Request restriction of processing under specific legal conditions.
• Withdraw consent for marketing or data processing.

We may refuse requests that are manifestly unfounded, excessive, detrimental to others' privacy rights, or contrary to legal obligations. If your request is valid and verifiable, we will respond within the timeframe prescribed by applicable law.

9. User Content and Licensing

User Content:

• Users may submit text, images, videos, and other content through CalmGuard services.
• Users are fully responsible for submitted content, and CalmGuard is not liable for content errors or omissions.
• Users acknowledge that content posted in public areas may be viewed by others.

User License: By providing your content on or through CalmGuard services, you grant CalmGuard a non-exclusive, non-transferable, non-sublicensable, worldwide, royalty-free right and license to use, copy, modify, publicly display, publicly perform, and distribute your content in the course of operating and providing CalmGuard services to you. We also have the right to reformat, create derivative works, excerpt, translate, modify, or otherwise alter your content for storage and viewing through CalmGuard services. This license is valid only during your use of CalmGuard services. When you delete your account or we delete your content pursuant to this policy, this license automatically terminates and we will cease using your content, except where backup retention is necessary to meet legal retention requirements. When you post or share your content for public viewing or in publicly accessible areas of CalmGuard services, other users may continue to access and share your publicly posted content, and you understand that such public content cannot be fully withdrawn.

CalmGuard Content: CalmGuard may also provide on CalmGuard services text, graphics, photographs, videos, images, illustrations, audio, music, comments, and other authored works owned by CalmGuard or from other users of CalmGuard services ("CalmGuard Content"). CalmGuard Content and the CalmGuard services and underlying technology are protected by U.S. and foreign copyright, trademark, patent, intellectual property, and other laws. You may access and view CalmGuard Content solely for personal use and consumption purposes, and without CalmGuard's prior written consent, you are prohibited from copying, selling, renting, distributing (including through digital distribution), publicly performing (including through digital performance), marketing, creating derivative works, or otherwise exploiting such CalmGuard Content.

Content Warranty: You represent and warrant that you own your content or have all the rights necessary to submit your content in the manner you choose, and that you grant us a license to use your content as described in this Privacy Policy. You warrant, represent, and agree that your content and your use and provision of your content on CalmGuard services will not: (i) infringe, misappropriate, or violate any third party's patent rights, copyright, trademark rights, trade secrets, or other intellectual property rights, or rights of publicity, privacy, or other rights; (ii) violate or encourage any act that would violate any applicable law, regulation, ordinance, or decree, or that would give rise to civil liability; (iii) be fraudulent, false, misleading, deceptive, defamatory, infringing, harmful, obscene, violent, vulgar, offensive, or otherwise objectionable content; (iv) promote discrimination, racism, hatred, harassment, or harm against any individual or group; (v) contain violent, threatening, or abusive content, or promote violent, threatening, or abusive behavior against any person or entity; (vi) promote illegal or harmful activities or substances.

10. Device Sharing

This app includes a device sharing feature that allows you, as the device owner ("Owner"), to share access to your monitoring camera device with other designated users ("Shared Users"), as well as a gallery statistics feature that provides aggregated insights about device usage, capture activity, and wildlife detection data. You acknowledge that enabling these features may expose sensitive information, including the precise geographic location of your device, and you bear full responsibility for the consequences of such sharing.

When you enable device sharing, Shared Users can access:

• (a) Photos, videos, and audio captured by the shared device;
• (b) Device location information, including GPS coordinates, geographic location metadata embedded in captured data, deployment area descriptions, and map-based visualizations;
• (c) Device status, battery level, signal strength, and firmware version;
• (d) Gallery statistics, including but not limited to capture counts, capture frequency, species identification results, activity timestamps, seasonal heatmaps, and behavioral pattern summaries.

Geographic Location Data — Sensitive Information Acknowledgment

You expressly acknowledge and agree that monitoring cameras and trail cameras are typically deployed in remote, private, or otherwise sensitive locations. Accordingly, geographic location data associated with your device and captured content is considered highly sensitive information. By enabling device sharing or gallery statistics, you expressly consent to our collection, processing, and storage of such geographic location data through the app and related cloud services, and display of such data to you and your designated Shared Users. You can disable geolocation tagging in the app settings; however, doing so may limit or disable certain features of gallery statistics, map-based visualizations, and location-based alerts. We bear no responsibility for any loss of functionality resulting from your decision to disable geolocation services.

Owner Controls, Consent, and Responsibility

• (a) You retain sole and absolute control over inviting, managing, and removing Shared Users. You may revoke sharing permissions or remove Shared Users at any time through the app. Upon removal, Shared Users will immediately and permanently lose access to all shared device data, including historical captures, statistics, and location history.
• (b) You are solely responsible for evaluating the trustworthiness of any Shared User before granting access. We strongly recommend that you share device access only with individuals you know and trust.
• (c) You understand and agree that disclosing your device location to Shared Users may expose you to risks, including but not limited to unauthorized physical access to your property by others, device theft, tampering, vandalism, or interference with lawful hunting or wildlife observation activities. We expressly disclaim any and all liability for any loss, damage, injury, or dispute arising from your decision to share device access or location data with any Shared User.
• (d) You agree to indemnify and hold us and our affiliates harmless from any claims, damages, or expenses arising from or related to your sharing of device access with Shared Users.

Data Aggregation, Anonymization, and Third-Party Processing

Gallery statistics data may contain aggregated and anonymized data derived from your device usage. We do not sell, rent, or share your precise geographic location data with third parties for marketing, advertising, or any commercial purpose unrelated to service provision. Any aggregated or de-identified data shared with third-party service providers (e.g., cloud infrastructure, analytics, map services) will be anonymized where technically feasible and contractually required. Certain features of device sharing and gallery statistics rely on third-party map or analytics services (e.g., Google Maps, Mapbox); your use of these features is subject to the respective third-party terms and privacy policies, which you should review separately.

Security and Data Retention

Shared device data is transmitted using TLS/SSL encryption and stored on servers protected by industry-standard security measures. We retain shared device data until the sharing relationship remains active, or until you delete your account or related content. You may request early deletion of specific shared data by emailing support@camomark.com; such requests will be processed within 30 days, subject to technical and legal retention requirements.

Law Enforcement and Legal Requests

Regardless of your sharing settings, we reserve the right to disclose device location data and related media to law enforcement or regulatory authorities when required by applicable law, court order, or in response to a genuine emergency involving imminent danger to persons or property. Where legally permitted, we will notify you of such disclosure.

Third-Party Services

The device sharing and gallery statistics features may integrate the following third-party services:

• (a) Map services: e.g., Google Maps (privacy policy: https://policies.google.com/privacy), used for displaying geographic location visualizations.
• (b) These third-party services may collect your IP address, device model, operating system version, and usage data (but not your precise geographic location data, unless you separately authorize it when enabling map features).

Your Responsibility: Your use of these features may be subject to both third-party terms and privacy policies. We recommend that you review the third-party policies at the links provided above. If any third party violates its commitments regarding your data processing, we will bear corresponding responsibility in accordance with the law and assist you in holding the third party accountable.

11. Children's Privacy

We do not knowingly collect any information from children under 13 years of age. Any use or access of CalmGuard services by individuals under 13 is strictly prohibited and violates our terms. If you believe we may have any information from or about a child under 13, or information from or about a child that was collected without verified parental consent, please contact us at support@camomark.com and we will delete such information.

If you are 13 years of age or older but under 18, you may only use CalmGuard services after a parent or legal guardian registers the product or creates an account for you, and under the supervision of a parent or legal guardian who has agreed to comply with our terms.

12. International Data Transfers

Your data will be routed to servers in the United States (California) or Germany (Frankfurt) for processing, depending on your region. We will take appropriate safeguards to ensure that your personal data is protected in accordance with this Privacy Policy, including the use of Standard Contractual Clauses and other lawful transfer mechanisms.

13. Policy Changes

We may update this Privacy Policy to reflect changes in practices or applicable law. Updates will be posted at the top of the page with a new "Effective Date." In certain cases, we may notify you via email or in-app alerts. Continued use of the application after updates constitutes your acceptance of the revised policy.

14. Account Deletion

To delete your account:

• Open the account settings in the application.
• Select "Delete Account."
• Enter your email address, and you will receive a verification code. Enter the verification code in the app to confirm.

Important Notice: Deleting your account will remove access to all related services, including those associated with your cameras. Please proceed with caution. After deletion, your personal data will be securely deleted or anonymized.

Deletion Scope: After account deletion, the following data will be permanently cleared:

• Your personal information (e.g., name, contact information, login credentials);
• Image and video capture content and associated metadata;
• Shared device access permissions and shared user relationships;
• Other published or stored content.

Complete Data Erasure: After account deletion is complete, relevant data will be permanently deleted from production systems. Due to technical limitations, residual data in backup systems will be automatically overwritten within 30 days.

Exceptions to Direct Deletion: If certain information must be retained after account deletion due to legal or regulatory retention period requirements (e.g., transaction records, security audit logs), we will anonymize such information so that it can no longer identify specific individuals, and will delete it upon expiration of the statutory retention period.
